A legal battle over a disputed court judgment involving the Catholic Diocese of Awka has taken a new turn, as activist Osita Obi and other plaintiffs challenge the circumstances surrounding the judgment and its execution.
The matter, marked MAW/1075/2025, came before Magistrate Court 4, Amawbia, on October 15, 2026. The plaintiffs, including Chidi Osakwe and six others, are challenging the judgment involving the Catholic Diocese of Awka and Rev. Fr. Chudy Aguinam.
The plaintiffs allege that the judgment was improperly obtained and executed, raising questions about service of court processes and claims that residents’ belongings were thrown out during the enforcement.
Counsel to the defendants, J.A. Obiajulu, challenged the jurisdiction of the Magistrate Court, arguing that the dispute concerns ownership and title to property, matters he said fall outside the court’s jurisdiction under Section 272(1) of the Constitution.
However, counsel to the plaintiffs, Martins Obi, maintained that the suit is not a property title dispute but concerns alleged fraud surrounding the judgment and its execution.
Activist Osita Obi also alleged that his wife’s shop was affected by the enforcement, adding a personal dimension to the dispute.
The competing arguments have placed the nature of the suit and the court’s jurisdiction at the centre of the proceedings. The allegations remain contested and are yet to be determined by the court.
The matter was adjourned to November 26, 2026, for further proceedings.
